Si conferma che il termine del 14 settembre 2026 alle ore 12:00 CET si riferisce esclusivamente alla FASE I – Qualificazione degli operatori economici della procedura.
Come specificato nelle Premesse del Disciplinare di Gara, la procedura è articolata in due distinte fasi:
FASE I – Qualificazione degli operatori economici, finalizzata alla verifica del possesso dei requisiti di ordine generale e speciale richiesti per la partecipazione alla procedura. Gli operatori economici interessati sono tenuti a presentare la domanda di partecipazione, corredata dalla documentazione richiesta dal Disciplinare di Gara, entro il termine sopra indicato;
FASE II – Presentazione delle offerte e negoziazione, alla quale saranno ammessi esclusivamente gli operatori economici qualificati all’esito della FASE I. Tali operatori saranno successivamente invitati a presentare l’offerta tecnica ed economica secondo modalità, termini e condizioni che saranno specificati nella Lettera di Invito.
Pertanto, il termine del 14 settembre 2026 non è riferito alla presentazione delle offerte, bensì esclusivamente alla presentazione della domanda di partecipazione e della documentazione necessaria ai fini della qualificazione nella FASE I della procedura.

Yes, we confirm that the deadline of 14 September 2026 at 12:00 CET refers exclusively to Phase I – Qualification of Economic Operators of the procedure.
As specified in the Premises of the Tender Rules (Disciplinare di Gara), the procedure is structured into two separate phases:
Phase I – Qualification of Economic Operators, aimed at verifying the fulfilment of the general and special requirements for participation. Interested economic operators are required to submit their application for participation, together with the documentation requested in the Tender Rules, by the deadline indicated above;
Phase II – Submission of Offers and Negotiation, which will be open only to the economic operators successfully qualified at the end of Phase I. The qualified operators will subsequently be invited to submit their technical and financial offers according to the terms, conditions and deadlines that will be specified in the Invitation Letter.
Therefore, the deadline of 14 September 2026 does not refer to the submission of tenders/offers, but solely to the submission of the application for participation for the qualification phase.

1) Modifica dell’operatore economico tra la FASE I e la FASE II

Come chiarito nel Disciplinare di Gara, la procedura è articolata in due distinte fasi. La FASE I è esclusivamente finalizzata alla qualificazione degli operatori economici, mentre alla FASE II saranno ammessi e invitati a presentare offerta esclusivamente gli operatori economici che abbiano completato con esito positivo la qualificazione.

Pertanto, l’operatore economico partecipante alla FASE II deve essere il medesimo soggetto giuridico che ha partecipato con esito positivo alla procedura di qualificazione nella FASE I.

La sostituzione dell’operatore economico qualificato con un diverso soggetto giuridico non può quindi ritenersi ammissibile, anche qualora tale soggetto appartenga al medesimo gruppo societario e sia stato inizialmente indicato quale subappaltatore nella FASE I. La circostanza che due soggetti appartengano alla medesima capogruppo non comporta, di per sé, che essi possano essere considerati come il medesimo operatore economico ai fini della procedura di qualificazione.

La posizione del subappaltatore è infatti distinta da quella dell’operatore economico che partecipa alla procedura e che, eventualmente, stipula il contratto con DTT. Di conseguenza, il soggetto indicato quale subappaltatore nella FASE I non può sostituire l’operatore economico che ha partecipato e conseguito la qualificazione nella FASE I.

2) Ruolo del contraente principale e responsabilità

Il contraente principale deve, in ogni caso, rimanere pienamente responsabile nei confronti di DTT per la corretta esecuzione del contratto e per l'adempimento di tutte le obbligazioni contrattuali.

Ai sensi dell'articolo 8 del Disciplinare di Gara, il subappalto è ammesso nei limiti e alle condizioni ivi previsti e nel rispetto dell'articolo 119 del D.Lgs. n. 36/2023 e solo per le attività espressamente indicate come subappaltabili.

Pertanto, un subappaltatore può fornire specifiche competenze tecnologiche e know-how e svolgere attività specialistiche nell'ambito delle prestazioni ad esso validamente subappaltate. Il subappaltatore non può tuttavia sostituirsi al contraente principale nell'esecuzione delle attività che, ai sensi del Disciplinare di Gara, sono espressamente riservate all'aggiudicatario e non possono essere subappaltate. In ogni caso, per le attività subappaltate sia il contraente principale che il subappaltatore ne rispondono in solido verso la Stazione appaltante.

1) Change of economic operator between PHASE I and PHASE II

As clarified in the Tender Documentation, the procedure is divided into two distinct phases. PHASE I is exclusively intended for the qualification of economic operators, while in PHASE II, only those economic operators who have successfully completed the qualification process will be admitted and invited to submit a bid.

Therefore, the economic operator participating in PHASE II must be the same legal entity that successfully participated in the qualification procedure in PHASE I.

Replacing the qualified economic operator with a different legal entity is therefore not permissible, even if that entity belongs to the same corporate group and was initially designated as a subcontractor in PHASE I. The fact that two entities belong to the same parent company does not, in and of itself, mean that they can be considered the same economic operator for the purposes of the qualification procedure.

The role of the subcontractor is, in fact, distinct from that of the economic operator participating in the procedure and, if applicable, entering into the contract with DTT. Consequently, the entity designated as a subcontractor in PHASE I cannot replace the economic operator that participated in and obtained qualification in PHASE I.

2) Role of the prime contractor and liability

The prime contractor must, in all cases, remain fully liable to DTT for the proper performance of the contract and for the fulfillment of all contractual obligations.

Pursuant to Article 8 of the Tender Competition Rules, subcontracting is permitted within the limits and under the conditions set forth therein and in compliance with Article 119 of Legislative Decree No. 36/2023, and only for activities expressly indicated as eligible for subcontracting.

Therefore, a subcontractor may provide specific technological expertise and know-how and perform specialized activities within the scope of the services validly subcontracted to it. However, the subcontractor may not replace the prime contractor in the performance of activities that, pursuant to the Tender Competition Rules, are expressly reserved for the successful tenderer and may not be subcontracted. In any case, both the prime contractor and the subcontractor are jointly and severally liable to the Contracting Authority for subcontracted activities.
